This agreement is created considering the website's service and orders offered to the user. Customers must obey the conditions of the service and the agreement beginning with the service activation date. It will provide a structure that will govern customers' purchases of UrlStart services from third parties. UrlStart reserves the right to reject any terms and conditions intended by the customer's form if they are additional and differ from the set maintained by UrlStart's service descriptions, order, or any service point.

Customer Agreement

  • The customer is responsible for ensuring the website's safety by not displaying any materials on the web.
  • Customers will not break, infringe, contravene or violate any Indian laws or regulations.
  • Users should not infringe on UrlStart's intellectual property or third-party rights.
  • Customers should not use defamatory and libelous statements.
  • It should not be threatening other users on the web or harassing work.
  • Users should not be discriminatory based on gender, age, or race and should not promote fate.
  • Customers should not violate any policy stated and posted on the website.
  • The system that the customers use should be virus free so that it should not cause any damage to UrlStart or third parties.

Abuse of Resources

Customers are not permitted to create hosting accounts using free domains such as .ga, .cf, .tk, .ml, etc. It's due to the free domain increasing the number of misuse and abuse situations. If you want to host a free domain, you must first get approval from our support. Such accounts that target specific geographical regions, governments, or countries where the government restricts trade and economic penalties will be barred. Customers should only use the policies specified for their or their clients' websites, whether shared hosting, cloud hosting, WordPress hosting, or reseller hosting. Because your site will be hosted in a shared environment, your hosting account will have limited resources.

In the case of account auto-creation by default, it will be suspended without prior notice and may ask for identity verification or change the domain name.

We have complete authority to suspend any of the accounts in question. If the account abuses resources like MySQL, IOPS, CPU, EP, or RAM, it will happen with or without notice.


Unsolicited commercial E-mail/Unsolicited bulk E-mail (SPAM)

  • The use of our system to send unsolicited commercial or unsolicited bulk e-mails is expressly prohibited.
  • Violations of our spam policy will result in a variety of other consequences.
  • If any of our users are found to have violated our spam policy, we take swift action, such as suspending or terminating the offending hosting account.
  • It should not use the services to send or create worms, internet viruses, or Trojan horses. Flooding, male bonding, pinging, and other denials of service attacks are also prohibited. Any damaging service performed by the customer may result in account suspension or termination.
  • Blacklist our system IP in various online databases will be limited, and suspend or terminate your account automatically. We will charge your account to run again with limited resources.

Bandwidth

We will notify all users when a user account's bandwidth limit is exceeded. Suppose the user does not need to purchase additional bandwidth or upgrade the service to continue exceeding their limit. In that case, the account will be suspended until the user takes steps to ensure that the limit is not exceeded again or until the account is upgraded, whichever comes first. Within the next month, it would reactivate the account automatically.


Permitted CPU and Disk Usage

The web hosting server's space can only be used for web files and hosting a user's website. You should not use this space to store media or other data, such as electronic files, website backups, FTP hosts, or demo purposes. We reserve the right to check each shared hosting account for excessive use of disc space, CPU, and other resources that may violate this Agreement or the AUP.

In our sole discretion, we may terminate access to the Services or remove or delete User Content from accounts deemed to violate these Terms and Conditions and other rules. The number of resources assigned to the plan that you have purchased will determine the dedicated and VPS usage limits.


Abuse Of Resources

  • Any attempt or actual hack of an UrlStart or any other firm, individual, or entity's network device is banned. Port scanning, IP range scanning, and vulnerability scanning are also included in this violation. All violations and suspected infractions will be thoroughly examined and may result in immediate service cancellation.
  • DOS attacks against UrlStart and any efforts to start a DOS attack from our servers are prohibited. All violations and suspected infractions will be thoroughly examined and may result in immediate service cancellation.
  • It is completely forbidden to host any software, source code, or other content that is illegal or might be used to commit an unlawful act. These are software exploits, exploit source code, hacking tutorials, hacking tools, viruses and Trojans, bomb manufacturing, and similar device tutorials. All violations and suspected infractions will be thoroughly examined and may result in immediate service cancellation.
  • Hosting information that violates any copyright, trademark, or service mark is wholly forbidden. It includes storing and transmitting unauthorized movies, music, software, ringtones, or anything else labeled "Warez." Any genuine complaint received will be examined and may result in service termination.
  • Hosting defamatory, scandalous, or private information about a person without their knowledge, inflicting emotional distress on purpose, or breaching trademarks, copyrights, or other intellectual property rights.
  • Any effort to destabilize or harm any of our servers is strictly banned. We accept no responsibility for how our clients' accounts are used. Any account that abuses resources and takes no action to stop the activity is subject to instant deletion without reimbursement.
  • Any site that we judge to be using excessive CPU cycles or resources that put other sites under strain may also be offered new terms ( i.e., upgrade). Although we offer 99.99 percent uptime, we cannot fully guarantee it was owing to the changes and upgrades we perform as part of our maintenance.
  • If a client disrespects any member of the UrlStart staff, we reserve the right to terminate their subscription without return.

Backup Policy

The customer's responsibility is to back up their data on UrlStart servers. UrlStart accepts no responsibility for any corrupted or missing customer data. We will not restore your data if your account or hosting is terminated. We will include the free backup service in the payment plan, but the user must purchase it individually for VPS and dedicated servers.

The seven-day backup policy will only apply to shared, WordPress, cloud, and reseller hosting. We are not responsible if the backup restoration fails or data is lost from our servers. We highly recommend taking data backups daily somewhere else to avoid these troubles. The UrlStart team, staff, and the company are not responsible for this data loss.


Reseller Terms and Client Responsibility

  • Reseller hosting plans are solely available for reselling web hosting. To sell any hosting package, you should purchase a reseller hosting plan.
  • A reseller hosting agreement must accept these agreements and other terms and legal policies.
  • Any reseller is entirely responsible for handling or managing client data and is liable for their backups.
  • You do not have the authority to sell any Shared/WordPress/Cloud hosting plans in a shared account. To become a reseller, you must first purchase a reseller hosting plan and agree to our terms.
  • We have complete authority to evaluate your reseller account to avoid any complications. You also agree to refrain from spamming, abusing, and phishing attacks; free domains are not permitted.

Uptime Guarantee

Our network providers will not be counted towards the uptime guarantee if there are any service outages or downtime due to UrlStart's scheduled maintenance. UrlStart accepts no liability or responsibility for the failure of third-party services. The customer is responsible for third-party services, and UrlStart is not liable for loss or delay in performing its respective obligations. Any failure or delay is caused by circumstances beyond its reasonable control, such as acts of any governmental body, war, fire, embargo, revolt, sabotage, flood, strike, or any other labor disruption. Unavailability delays, interruption or delay in telecommunications or third-party services (including DNS propagation), failure of third-party software or hardware, or inability to procure raw materials, supplies, or electricity utilized in or equipment required for the provision of the services.

The uptime guarantee did not cover server downtime caused by unauthorized access, failed login attempts, or an excessive number of connections from the customer's IP. In the event of a calamity, uptime will not be affected. Our 99.99% may be affected by this, which will not be included in the uptime guarantee. We will notify you by email about the scheduled maintenance. However, any such downtime without notice or something happening due to a hardware issue is not eligible, and UrlStart is not responsible for it.


Account Security and User Verification

At the application level, the customer must encrypt critical customer data because the data will be considered secret under state or federal legislation and any contractual duties to others. In the event of a mishap, the customer must contact UrlStart and warn them of any security breach.

You may need to authenticate your identity to avoid fraud and abuse. Using any form of proxy, VPN, or similar service is not permitted for user registration. To sign up with UrlStart, you must use your actual telecom or residential IP address. If verification fails, the account may be banned or permanently closed.


Billing & Refund Policy

If you pay with a debit or credit card, Internet Banking, or PayPal, we will activate your account immediately after the payment is confirmed. Sending payment by offline modes, such as NEFT, IMPS, bank transfer, or another method offered on UrlStart, may cause your order to be processed late. We advised using the automated payment to prevent manual verification, and the order was activated instantly.

Money-Back Guaranteed
  • The Money Back Guarantee applies solely to the following services: Shared Hosting, WordPress Hosting, Cloud Hosting, Reseller Hosting, and VPS Hosting. Other services, add-ons, licenses, or anything else you ordered, excluding the setup cost, were not eligible for reimbursement.
  • The 7-day money-back guarantee applies solely to first-time signups. Signups for the second and subsequent times are not eligible. For example, if you previously had an account with us, canceled it, and signed up again, you will not qualify for a refund, nor will you be eligible if you have started a second account with us.
  • Domain registration/transfer/renewal, as well as any other paid licenses, setup fees, or add-ons, are not refundable.
  • We will issue no refund if your service(s) are suspended or canceled for any reason.
  • The refund will not cover any taxes, setup costs, refund processing fees, postage charges, payment processing fees, or bank fees (s). There will be no reimbursements provided if it involves the web hosting account in a breach of our terms of service, any form of illegal or system resource over-utilization, or if the refund policy as stated below is more than 7 days old.
  • Suppose you confirmed your decision to cancel your hosting package and ordered a free domain. We will refund the remaining payment after we deduct the domain cost. We cannot cancel the domain name, but it will continue to function following the cancellation of your hosting package. To avoid extra expenses, you can cancel your domain name at the end of the billing cycle. The domain name will be free for the first year, with renewal fees beginning in the second year.
  • Bank transfer, cheque, credit in account, cash deposit, and DD payments are non-refundable. The refund will be credited to your hosting account.
  • After seven days, we will ignore your refund request, and you will not be entitled to a refund.
  • Making the cancellation request via a client area support ticket should be possible.
  • The refund process would take 1-2 weeks after sending the cancellation request.
  • There will be no refunds for abuse of spam, mass email, illegal use, adult websites, or copyright claims, and we will suspend the service immediately.

Cancellation Process

  • If you choose to terminate our services at any moment, please submit a cancellation request through your client area. You must first pay off all outstanding debts (if any).
  • You have the option of canceling immediately or requesting cancellation when your subscription period finishes. You will lose access to your hosting plan/service if you choose immediate cancellation. If you want to cancel after the tenure time has expired, you will continue to have access to the services purchased until the conclusion of your prepaid term.
  • Before submitting the cancellation request, you must back up all of your data. When you cancel your account, we destroy all of your data on our server, which cannot be recovered or restored.

  • Late Payment or Non-Payment Account Termination

    If you do not pay for Shared Hosting, WordPress Hosting, Cloud Hosting, Reseller Hosting, or VPS within 48 hours, we will suspend your service, and if you do not pay within 7 days, we will cancel your benefits and services.

    We cannot perform any backup recovery after the service has been discontinued. Please ensure that you have the data and cannot request it. The procedure can't be irreversible.


    Data Protection and Security

    Customer Data: The customer is solely responsible for all data security and content stored in UrlStart's environment. At all times, the customer data is the client's property.

    Legal Prerequisites: The client will determine whether any data meets the standards, laws, and policies. The consumer must ensure that the data meets all legal criteria.

    Security: The customer must encrypt critical customer data at the application level. This is taken into account because the customer data will be considered secret under state or federal legislation and any contractual duties to others. In the event of a mistake, the customer must contact UrlStart and warn them of any security breach.


    Dispute Resolution Jurisdiction

    If a dispute, controversy, or claim arises from or related to this agreement, you and UrlStart must reasonably attempt to resolve such issues or differences. To that end, we will consult and negotiate to establish an acceptable solution for both parties.

    You agree that the courts of Prayagraj, Uttar Pradesh (India), will have exclusive jurisdiction over all disputes and other matters relating to the execution, interpretation, enforcement, and termination of this agreement or any additional agreement entered into by the parties in connection with it. All disputes and other matters relating to the interpretation and enforcement of the TOS and any other agreement entered into by the parties will be governed by Indian law.


    Price Change

    We have the right to update the pricing information at any moment. You have to double-check pricing details whenever you use any service.


    TOS Modifications

    We want to inform you that we reserve the right to amend our terms and policies at any moment. We do not issue and distribute any notifications before modifying our services. You can reach out to us for updates.
